Access (Legal)


Seller warrants that there is legal access between the property and a public roadway. If property does not border a public street, road or highway, Seller shall, on or before fifteen (15) days prior to closing, furnish to Buyer, at Seller's expense, one of the following: (1) copy of a recorded access easement, running in favor of any and all title holders of the property; or (2) an easement in recordable form, from the (servient) owners of the property over which the easement is to run, and running in favor of Buyer, Buyer's heirs, assigns, and successors in title. Seller shall pay for recording said easement and all other related expenses.
